Short Term Rental Registration

short term rental

On September 5, 2023, the Halifax County Board of Supervisors adopted Ordinance 2023-9 (enclosed) which amends and reenacts Chapter 53 of Halifax County Code as it relates to Short Term Rental definition, allowed operation, and regulations. As a result, ALL entities within Halifax County (but not located in the Towns) who advertise or offer a dwelling/room for compensation for a period of fewer than 30 days, must follow the newly adopted guidelines for Short Term Rental Registration.

As part of the Ordinance, Short Term Rentals are now allowed by right in all zoning districts unless the Short Term Rental shares amenities such as a pond, pool, roadway, etc., in which case the Short Term Rental owner must apply for a Conditional Use Permit. In addition, Short Term Rentals which allow hunting on the property must also apply for Conditional Use Permit.

According to the adopted Ordinance, ALL Short Term Rentals operators must submit a Registration Application to Halifax County Administration. The annual registration requires a $75 registration fee. Additionally, Short Term Rental operators must comply with the list of requirements found in Section 53-20 of the Ordinance, and compliance will be confirmed by a Halifax County Building Inspector before operation can continue.

Consultation with Halifax County Planning & Zoning staff is strongly recommended to ensure all requirements are understood and met.

Forms needed may include:
Short Term Rental Regulations and Registration Application
Business License Application

For questions, contact the Halifax County Zoning Administrator at 434-476-3300.
